1. Acceptance of Terms

By accessing and using the website and services of Red Hawk Roofing LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Site or services. We reserve the right to modify these Terms at any time. Continued use constitutes acceptance of updated Terms.

2. Description of Services

Red Hawk Roofing provides the following services:

• Free Inspections & Estimates: On-site roof assessments and cost estimates for roofing work.
• Roof Replacement & Repair: Installation, replacement, and repair of residential roofing systems.
• Maintenance Program: Routine roof maintenance, inspections, and debris removal (NOT INSURANCE — see Section 9).
• Customer Portal: Web-based portal for portal customers to view project status, documentation, and communication history.
• Insurance Claims Assistance: Help navigating roof damage claims with insurance carriers.

3. Eligibility

By using our Site and services, you represent that:

• You are at least 18 years of age.
• You are the property owner or have written authorization from the property owner to request services.
• You are not prohibited by law from using our services.
• All information you provide is accurate, current, and truthful.

4. Account Creation & Responsibility

If you create a customer portal account, you are responsible for:

• Providing accurate, complete account information.
• Maintaining the confidentiality of your password.
• Immediately notifying us of any unauthorized access or breach.
• All activity under your account.

We are not liable for unauthorized access to your account if you fail to protect your password.

5. Acceptable Use

You agree not to:

• Scrape, crawl, or automate extraction of data from our Site without written permission.
• Harass, abuse, or threaten Company employees or other users.
• Attempt to gain unauthorized access to our systems or networks.
• Post unlawful, defamatory, or obscene content.
• Interfere with the normal operation of the Site or services.
• Use the Site for any illegal purpose or in violation of local, state, or federal law.

Violation of acceptable use policies may result in immediate termination of your account and access to our services.

6. Intellectual Property

All content, logos, text, images, and design on our Site and materials provided by Red Hawk Roofing are the exclusive property of the Company and protected by U.S. copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to view and use the Site for personal, non-commercial purposes. You may not:

• Reproduce, distribute, or modify any content without permission.
• Use our logos, trademarks, or brand materials without authorization.
• Remove or obscure copyright or attribution notices.

Unauthorized use may result in legal action.

7. User-Submitted Content

If you submit content to our Site or services (including photos, reviews, testimonials, or project documentation), you:

• Represent that you own or have the right to use such content.
• Grant Red Hawk Roofing a non-exclusive, royalty-free license to use, reproduce, and display your content for business and marketing purposes.
• Agree that we may use your testimonials and project photos in advertising and promotions without additional compensation.
• Indemnify us against claims arising from your submitted content.

8. Pricing & Estimates

Estimates provided by Red Hawk Roofing are subject to change based on:

• An in-person inspection of the property and roof condition.
• Verification of property ownership and insurance coverage.
• Scope of work and complexity upon closer examination.
• Changes in material costs or labor.

Estimates are valid for 30 days unless otherwise specified. We reserve the right to adjust pricing if circumstances materially differ from the initial estimate. A revised estimate will be provided before work begins.

9. Maintenance Program Disclaimer

Important: The Red Hawk Roofing Maintenance Program is a service plan for routine roof maintenance, inspection, and debris removal. It is NOT an insurance policy.

• The maintenance program does not cover damage from storms, accidents, vandalism, or defects.
• Coverage is limited to the specific services outlined in the written service agreement.
• For coverage of roof damage, you must obtain a separate homeowners or commercial insurance policy.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• Red Hawk Roofing's total liability for any damages arising from your use of our Site or services shall not exceed the total amount you paid for services in the 12 months preceding the claim.
• We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business interruption, even if advised of the possibility of such damages.
• We are not liable for delays or failures in service due to causes beyond our reasonable control (force majeure).

Some jurisdictions do not permit limitation of liability, so this limitation may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Red Hawk Roofing, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the Site or services.
• Your violation of these Terms or applicable law.
• Your infringement of third-party intellectual property rights.
• Any content you submit or user-generated content.
• Your breach of your responsibilities as a property owner or account holder.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Colorado.

You consent to the jurisdiction and venue of these courts and waive any objection to venue or claim that proceedings have been brought in an inconvenient forum.

13. Dispute Resolution

Before initiating any legal action, you agree to attempt to resolve disputes through good-faith negotiation with Red Hawk Roofing. Please contact us at info@redhawkroofing.com with a detailed description of the dispute.

If the dispute is not resolved within 30 days of good-faith negotiation, either party may pursue arbitration or legal action as permitted by Colorado law.

14. Termination

We may terminate or suspend your account and access to our services at any time, for any reason, including:

• Violation of these Terms.
• Non-payment or breach of service agreement.
• Abuse, harassment, or threatening behavior.
• Illegal activity or violation of law.

Termination does not limit our right to pursue further legal action. Upon termination, your right to use the Site and services immediately ceases.
